Apple wants to stop the ban on the Apple Watch Series 9 and Ultra 2, but its idea seems insufficient

The focus of these efforts is on making changes to the device’s algorithms, especially those related to measuring the user’s blood oxygen level. This aspect is key, since Masimo specifically stated that Apple infringed its health-related patents.

Gurman notes that the company is racing against time to fine-tune the technology that determines oxygen saturation and how it presents this data to users. However, the question arises: will it be enough to convince regulators and allow Apple to continue selling its smartwatches in the United States?

“The patents at the center of the dispute are mostly related to hardware” explains Gurman. Her own Masimo has also expressed skepticism that a solution based only on software.

In case the changes are not effective, Apple will sadly be forced to make changes to the hardwarea process that could take at least three months, considering the production and shipping of the new models.

Additionally, additional time will be required for the US customs agency to approve these changes, which could translate into a considerable delay and therefore huge losses for Apple.

Despite all this, mention that this measure only affects sales in the United States, which is where the complaint has occurred, and they can be purchased in other stores, but only while there is stocks.
